This Cookie Notice explains what cookies and similar technologies are, which of them are used on www.powergas.com (the "Website"), what they do, how long they last, and how you can control them. It forms part of the Powergas Privacy Notice and should be read together with it.
Powergas Global Investment Nigeria Limited and Powergas Ebedei Limited, together "Powergas", "we", "us" and "our", of 21 Adeniyi Jones, Ikeja, Lagos State, Nigeria, are the data controllers in respect of the personal data collected through cookies on the Website. Our Data Protection Officer may be contacted at info@powergas.com.
A cookie is a small text file that a website places on your device when you visit it. Cookies allow the website to recognise your device, to remember your actions and preferences over a period of time, and to collect information about how the website is used.
Cookies set by the website you are visiting are called first party cookies. Cookies set by another organisation whose content or services are embedded in that website are called third party cookies. A session cookie is deleted when you close your browser. A persistent cookie remains on your device until it expires or until you delete it.
This Notice also covers technologies that work in a similar way to cookies, including pixels and tracking beacons, software development kits, browser local storage and session storage, and device fingerprinting techniques. Wherever this Notice refers to cookies, it refers to those technologies as well.
Article 40 of the GAID requires the active consent of the data subject for the use of cookies, save for cookies that are strictly necessary and which do not process sensitive personal data, financial data or data stored privately by a data subject.
Accordingly, when you first visit the Website you will be shown a consent banner. That banner gives you a genuine and equally prominent choice between accepting and rejecting non-essential cookies, and allows you to make a separate decision for each category of cookie described in paragraph 4. We place no cookie on your device other than strictly necessary cookies until you have made that choice.
We do not use pre-ticked boxes, and we do not treat scrolling, continued browsing or the closing of the banner as consent. Rejecting non-essential cookies is as easy as accepting them, and the Website remains fully usable if you reject them.
Where we ask for your consent, we record the fact and date of your consent, the version of this Notice you were shown, and the categories you accepted or rejected, so that we can demonstrate our compliance. We will ask you again at least every twelve (12) months, and sooner if we introduce a new cookie or change the purpose of an existing one.
You may change or withdraw your cookie choices at any time, and as easily as you gave them, by clicking the "Cookie Settings" control which appears persistently on every page of the Website. Withdrawing consent does not affect the lawfulness of anything done on the basis of your consent before you withdrew it. Where you withdraw consent, we will stop setting the relevant cookies and will delete or de-identify the data already collected through them, to the extent it remains within our control.

Where a cookie is set by a third party, that third party determines the purposes for which it processes the data collected, and its own privacy and cookie policies apply. We have no control over those cookies, and we encourage you to read the relevant third party policy before consenting.
The data collected through cookies may include your IP address, device and browser characteristics, operating system, approximate location derived from your IP address, referring website, the pages you view, the links you click, the time and duration of your visit, and a randomly generated identifier assigned to your device. Where this information can be associated with you, directly or indirectly, it is personal data and is processed in accordance with the Powergas Privacy Notice.
We do not use cookies to collect sensitive personal data, and we do not use them to make any decision about you that produces legal effects or that similarly significantly affects you.
Some of the third-party providers listed in paragraph 5 are located outside Nigeria, and consenting to their cookies may involve a transfer of your personal data outside Nigeria. Such transfers are made only where the conditions in sections 41 to 43 of the NDPA and the corresponding provisions of the GAID are satisfied. Paragraph 9 of the Powergas Privacy Notice sets out how we approach those transfers.
Each cookie expires after the period stated in the table in paragraph 5. Data derived from analytics cookies is retained in aggregated or pseudonymised form for no longer than twenty-six (26) months from collection, after which it is deleted or fully anonymised. Records of your cookie consent are kept for twenty-four (24) months from the date the consent was given or last renewed, so that we can demonstrate that consent was properly obtained.
Independently of our banner, you can control cookies through your browser settings. Most browsers allow you to see what cookies are stored, to delete them individually or entirely, to block third party cookies, to block cookies from particular sites, to block all cookies, and to delete all cookies when you close the browser. The settings are found in the privacy or security section of your browser. You may also use your browser’s private or incognito mode, which discards cookies at the end of the session.
Please note that blocking all cookies, including strictly necessary cookies, will affect the operation of this and most other websites, and that deleting cookies will also delete the record of your preferences, so that you will be asked for them again on your next visit.
You have the rights set out in paragraph 11 of the Powergas Privacy Notice in respect of personal data collected through cookies, including the right of access, the right to erasure, the right to object, and the right to withdraw your consent at any time. To exercise any of them, contact our Data Protection Officer at info@powergas.com. You may also serve a Standard Notice to Address Grievance on us under Article 47 of the GAID, and you may complain to the Nigeria Data Protection Commission at info@ndpc.gov.ng or through www.ndpc.gov.ng.
We review this Notice every six months and following any change to the Website that affects the cookies it sets. The current version is always available at www.powergas.com. Where we introduce a new non-essential cookie, or change the purpose of an existing one, we will seek your consent afresh before it is set.
